Terms & Conditions
These terms form an agreement between you and NovaTech ("we", "us"), Beirut, Lebanon, covering your use of the Nova Card applications and this website. By installing or using Nova Card you accept them. If you do not agree, please do not use the app.
1. What Nova Card is
Nova Card is a mobile application for creating digital business cards, sharing them by QR code or file, displaying payment links to licensed providers, and recording contact details that people choose to give you. It runs on your device and stores your information there. It is a tool, not a service that holds your data for you.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Nova Card for your own business or personal purposes, in line with these terms and with the rules of the app store you installed it from. You may not copy, decompile, reverse-engineer, resell or redistribute the app, remove its branding, or use it to build a competing product.
3. Your data is your responsibility
Because your cards and leads are stored only on your device:
- We cannot recover them if your phone is lost, damaged, reset, or if you uninstall the app.
- Keeping backups is up to you. The app includes an export function for exactly this reason, and we recommend using it.
- We are not liable for loss of data that we never held.
4. Payment links
This section matters, so it is stated plainly:
- We are not a payment provider. Nova Card does not hold, transfer, process or store funds, and is not licensed to do so.
- The app stores payment links and account details that you supply and displays them on your card. When someone taps one, the app shows them the destination and opens it.
- Every payment happens between that person and your licensed provider, governed by that provider's terms. Any dispute, refund, fee, delay or failure is a matter between you, your customer and that provider.
- You are responsible for ensuring that the links and account details you publish are correct, are genuinely yours, and that you are entitled to collect payment in the way you present.
- The app checks links for basic safety before saving them and warns when it cannot verify a website. These checks reduce risk; they are not a guarantee, and they are not an endorsement of any provider.
5. Collecting other people's information
When you use the lead capture feature, you become responsible for the personal data you collect. You agree that you will:
- collect details only from people who genuinely consent, using the consent control the app provides;
- use those details only for the purpose the person reasonably expected;
- respond to requests from those people to see, correct or delete their information;
- comply with the data-protection and anti-spam laws that apply where you and they are located.
We provide the tool and record the consent timestamp for you, but we are not the controller of that data and cannot answer for how you use it.
6. Acceptable use
You may not use Nova Card to impersonate another person or organisation, to publish payment details that are not yours, to defraud anyone, to distribute unlawful or infringing material, or to collect personal information without consent. We may terminate your licence if you do.
7. Intellectual property
The Nova Card name, logo, design and software are owned by NovaTech and its licensors. Your content — your cards, images, documents and leads — remains entirely yours; we claim no rights over it, and since it never reaches us, we could not use it in any case.
8. Availability and changes
The app works offline by design, so its core function does not depend on us staying online. We may release updates that add, change or remove features, and we may discontinue the app. Where a change would materially reduce what the app does, we will give reasonable notice so you can export your data.
Features described as forthcoming — including public card pages, wallet passes, analytics and team accounts — are plans, not commitments, and no purchase or decision should be made in reliance on them.
9. Third parties
Nova Card links to services we do not control, such as banks, Whish Money, payment gateways, messaging apps and map providers. We are not responsible for their content, availability, terms or practices. Their names and marks belong to them, and their appearance in the app does not imply a partnership unless we say so explicitly.
10. Disclaimer and liability
Nova Card is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows, including any implied warranty of merchantability, fitness for a particular purpose, or uninterrupted or error-free operation.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, for lost profits, lost business or lost data, or for anything arising from a payment made through a third-party provider. Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence. Where liability cannot be excluded, it is limited to the amount you paid us for the app in the twelve months before the claim.
11. Termination
You may stop using Nova Card at any time by uninstalling it, which removes your data from the device. We may suspend or end your licence if you materially breach these terms.
12. Governing law
These terms are governed by the laws of the Republic of Lebanon, and the competent courts of Beirut have jurisdiction over any dispute, without prejudice to mandatory consumer protections available to you where you live.
